New York filed a lawsuit against Polymarket, the largest event prediction market platform in the United States. Attorney General Letitia James petitioned the state court on September 24 to have it order an injunction prohibiting QCX LLC, which operated under the name Polymarkets U.S., from offering events contracts without a state gambling license, along with compensatory and compulsory restitution of property.2025
What's going on?
The lawsuit alleges that Polymarket offers promises tied to sports, elections and cultural events where users risk money with uncontrolled outcomes, thus entering a gambling network as defined by the state of New York. Governor Kathy Hochul said: "Calling it a prediction market does not change the fact that if you bet in New York you must be under our gaming laws".
What makes this case interesting is that Polymarket, rather than being a federally unlicensed company, QCX has been certified by the U.S. Commodity Futures Trading Commission (CFTC) as a regulated contract market since July,[8] but New York State does not agree that such federal regulation helps to circumvent state gambling regulations.
The point the state made in evidence.
The investigative team found that the platform had marketplaces related to the New York Mets, college football, New York state gubernatorial elections and the reality show "Big Brother", while the company's ads stated it was "legal in all 50 states" and its December U.S. app launch campaign2025 said "sport is followed by all markets", including a promotional sample reading "TRADE EVERY FOOTBALL GAME IN ALL 50 STATES".
Another allegation was that Polymarket's user age range is open to those 18 and older, but New York mandates mobile sports betting must be 21 or over. The state has asked the court to prohibit under-21s from wagering.[citation needed] In addition, it alleges violations of the federal Wire Act by transferring sports gambling data and payment confirmations across state lines.
How much damage?
That the state of New York requires covering more than just stopping sports betting: -
- The ordinance prohibits residents from operating any unlicensed gambling business in New York, including advertising and solicitation.
- Disclosure of accounts identifying customers, betting lists, customer losses and company profits.
- Refunds customers in full, with damages and enforced restitution.
- The fine is three times the profits from illegal activity.
- For sports betting$100,000 for offering or attempting to offer unauthorized mobile phone gambling 1 time, unspecified number of times
Prosecutors said Polymarket had been operating a sports betting platform in New York since at least January 23,[3] and also continued to advertise to people in the state.
Why is this important?
James sued Coinbase Financial Markets and Gemini Titan in April on related charges, and Kalshi, another CFTC-certified contract marketplace. Earlier in July, James and Hochul disclosed that Kalsha had already lost a lawsuit against the New York State Gambling Commission.
This means that the battle between federal differential regulation and state-level gambling laws is widening for digital currency users in Thailand. These directions are significant because if the "prediction market = betting" trend continues to prevail, similar platforms will be more restricted access in many countries while in Thailand this activity must fall under the SEC (Thailand) and Thai's stricter gambling law.
James said, "Polymarket circumvents New York's laws by targeting the most vulnerable and depriving New York families of critical services and support".
This case isn't going away anytime soon, because Polymarket may have weakened the CFTC's regulatory standards and its ruling will become a benchmark for the entire U.S. stock market industry.
