the SEC (Thailand) pushing for the amendment of four capital market laws, addressing six key issues. Increased regulatory rigor over Thai capital markets

The Office of the Securities and Exchange Commission (SEMC) has pushed for four amendments to the Capital Markets Act, covering a total of six key issues in order to enhance regulatory oversight of Thailand's capital markets.

the SEC (Thailand) What's the offense this time?

the SEC (Thailand) has come out in support of four simultaneous amendments to the Capital Markets Act, which is a comprehensive solution rather than a one-point solution. The scope of the amendment covers six key issues that are considered as the basic structure for regulating Thailand's capital markets.

This impetus comes from the need to adapt regulation to more rapidly changing markets, financial technology and new forms of investment that are emerging.

Why is this important?

Thailand's capital market law, specifically the Securities and Capital Markets Ordinance which has been in force since 2010,2535 was designed at a time when markets were still functioning traditionally. The Digital Asset Law (DAS) 2561 is several years old as new investment products and channels such as digital assets, stablecoins and online investment platforms are developing faster than existing laws.

When the law doesn't catch up, investors and entrepreneurs alike face uncertainty. Investors may not be fully protected in a new product; there is no clarity on what can or cannot be done by an entrepreneur.

How would that affect the general investor?

For retail investors who invest through the Thai Stock Exchange, or those who buy and sell digital assets via licensed platforms such as the SEC (Thailand) Digital Asset Exchanges in Thailand, this amendment means that rules applying to providers may change regarding standards of care for customer funds and assets, disclosure and investor protection measures.

The next thing to watch is the process of parliamentary consideration, and details on all six issues will be gradually revealed because the specifics in each issue will determine who benefits and how much adjustment. Interested investors should follow the announcement from the SEC (Thailand) directly for accurate information before deciding to invest in products under this new set of laws.
