Mark Uyeda, former chairman of the U.S. Securities and Exchange Commission (SEC) before Paul Atkins was sworn in, revealed that the agency had withdrawn a lawsuit filed against cryptocurrency companies under previous administrations because they were preparing to change regulatory policy "totally".
Speaking at the Psaros Center for Financial Markets and Policy's Financial Market Quality Conference on Wednesday, Uyeda said that SEC has decided to drop cases involving crypto companies in early 2025 because further proceedings could undermine the agency's credibility when it comes to arguing opinions in court in a way that is inconsistent with policies that are about to change. He noted there was "significant concern" that cases filed against those crypto companies "may have no legal basis".
"I can't let our lawyers even have a case that was approved by the board of directors before it stood up in court and then the board reversed out an interpretation which is a 180-degree change from what they were arguing", the chairman said, "and I think it would undermine the credibility of the agency".
During Uyeda's tenure as president from January to April 2025, SEC dropped lawsuits against Kraken , Ripple Labs, Coinbase and other companies that many critics see as industry retaliation for supporting President Donald Trump's candidacy in 2024.
Uyeda has held the SEC seat since 2022 and is currently working alongside agency leaders such as Atkins and chairwoman Hester Peirce. When Peirce expects to leave in November, the committee whose total of 5 seats will be left with only 2 members by Trump has not yet announced a list of nominees who would replace the vacant position.
