The U.S. Supreme Court may have to single out the sports prediction market as a gambling commodity or a federal issue.
The conflict between the courts has become an issue.
Last month, it was reported that the U.S. Supreme Court might intervene in sports betting; now that equation hasn't changed, but a major controversy has emerged between two appellate courts, one of which ruled that sports-related betting is gambling and should be regulated by the state, while the other ruled it falls under the jurisdiction of the United States Commodity Futures Trading Commission.
Most of the lawsuits are in favor of the state.
Last week, an outsider lawsuit filed in the Supreme Court mostly sided with states, which means that at a minimum sports betting markets should be classified as gambling products under state regulation, not federal.
A voice from former Senator Dodd.
Former Senator Chris Dodd, whose name appears in the Dodd-Frank Wall Street Reform and Consumer Protection Act of 2000,[14] which is at the heart of this debate, filed a complaint stating that such legislation was not intended to give the U.S. Commodity Futures Trading Commission power over state governments and states' ability to regulate gambling.
Reason to appeal the decision of the Third Circuit Court of Appeals.
Dodd's complaint disagreed with a 3rd Circuit Court of Appeals judge who ruled by a 2-1 majority that the U.S. Commodity Futures Trading Commission had jurisdiction over swap contracts and prediction markets covering sports, stating there was a line between discrimination as a financial instrument and sports betting.
The complaint cited examples of sports-related outcomes prediction markets that were popular, such as parlay bets linking multiple betting lists together which are often odds or player performances across games, cities and sports. It stated these did not help with risk prevention or price discovery, nor do they relate to the type of potential financial, economic or commercial impact defined by Commodity Exchange Act as a swap contract.[citation needed]
Something the reader should notice.
The issue is not just a disagreement between agencies, but the question of whether sports betting markets should be classified as financial or gambling markets. If the Supreme Court were to rule on it, the ruling would set out regulatory guidelines and legal uncertainty that remain pending.
It's a warning.
