The big picture.
The U.S. Commodity Futures Trading Commission, or CFTC, has proposed new rules to regulate the trading and markets of digital assets, according to a reportBitcoin Magazine by Mathew Di Salvo in a document released Monday and posted on Twitter 's Bitcoin Magazine (@BitcoinMagazine) on October 5.2026

The proposal states that the new law will open up cryptocurrency exchanges in the United States to opt into a federal regulatory system. If approved, platforms offering leveraged trading would be able to register with regulators.

Commission Chairman Mike Selig noted that today's action is an important step in the commission's ongoing efforts to keep the United States as the crypto capital of the world.

The post on Twitter 's Bitcoin Magazine states "Breaking news: CFTC proposes US crypto market regulation", with Selig stating that "Today's action is just the beginning...The United States can lead the next generation of financial technology without repeating previous generations mistakes".

Selig added that the commission's announcement marks the beginning of a new regulatory process based on CEA intent and President Donald Trump's mandate to propose a federal-level digital asset supervision marketplace framework using CFTC's existing legal authority.

Political pressure and the legal framework that lies
Although the legislature blocked a draft of the Clarity Act last month, the CFTC and SEC are still moving forward with proposals to regulate the digital asset industry.

The Clarity Act seeks to divide regulatory authority among formal regulators by separating the categories of digital assets into securities, commodities or stablecoins.

However, the bill stalled this year due to concerns from banking interest groups about crypto companies paying stablecoin rewards to customers and some lawmakers, mostly Democrats, had ethical concerns over the legislation.

Regulators are continuing to craft regulations that the crypto industry has long demanded, without waiting for a bill to pass.

Selig previously served as the chief legal advisor of crypto 's Task Force,SEC and last month said that the agency was preparing to handle the market transition by moving into an on-chain 24/7 system.

Attitudes of SEC and management
It is the largest cryptocurrency exchange in the world by market capitalization.SEC Under a crypto-supporting regulator, it approved token trading in September.

Prior to that, in AugustSEC it had outlined its own round for digital asset offerings amid major pending legislation.

President Donald Trump gained prominence with policies supporting the digital asset industry, and after taking office signed executive orders that supported crypto.

In August, Trump urged lawmakers to pass the Clarity Act, calling it "powerful".

What it means to an entrepreneur.
If the CFTC rules are approved, crypto exchanges in the United States will have an option to enter into a federal regulatory system and platforms that offer leveraged trading services may be required to register with regulators.

The process isn't over, because it's still a preliminary proposal, not the final rule.

The next step.
The CFTC's preliminary hearing notice will be open for public comment 60 days after publication in the Federal Register.

Then the agency reviews that feedback and decides whether to issue a formal rule proposal, which would be open for comment before it becomes final.
