The CFTC warns of the risk that forecast markets may be distorted by individual statements and participation activities.

The CFTC indicates the market is anticipating a speech or participation event with high risk of distortion in its September 22nd guidance.

What's this about?

The U.S. Commodity Futures Trading Commission, or CFTC, stated in a guidance dated September 22 that prediction markets open to trading on whether an individual will utter words of encouragement or attend events are products at high risk for manipulation, proposing stricter oversight criteria for market-regulated derivatives exchanges, or DMOs, under the CFTC's supervision.[1]

The guideline also states that contracts whose outcome depends on the words, participation or interaction of an individual may be determined by a single person or close associates. Sales should therefore examine the independent legal and professional responsibilities of influencers to the outcome as well as the possibility that external pressures will lead to distortions.

Why does it matter?

Prediction markets are often understood as reflecting the likelihood of future events, but when the outcome is based on the behaviour of a few individuals, contract prices may not be driven by large amounts of data from market participants such as those associated with commodity prices or more difficult-to-measure indices.

The ability of a single individual to trigger or terminate contracts instantly allows for external incentives to change outcomes in line with the ownership status of certain groups, and the CFTC considers that these product groups require stricter pre-trade inspections to maintain transparency of market mechanisms and reduce the risk that ordinary users will be harmed by distorted behavior.

How would the criteria work?

The September 22 guidance does not specify a specific price or product, but provides the framework for trading markets subject to regulation by the CFTC. A key issue is whether the market must consider that an individual or group of individuals affecting the deal has separate legal and professional responsibilities independently.

If the speaker or attendee is an authority deciding alone, the risk increases because many contract holders may benefit from a single person's behavior. Additionally, markets need to evaluate external pressures that might cause that individual to change his speech or appearance, so scrutiny can encompass conflicts of interest, links with market members and more explicit contractual judgement mechanisms than usual.[citation needed]

What should Thai and Myanmar users be aware of?

This is a U.S. regulator's approach, not an order directly to the platform in Thailand or Myanmar, but Thai users accessing global platforms may see changes such as slower opening of contracts, restrictions on status sizes, requests for additional identity verification information, and consequent withdrawals associated with celebrity speeches and contributions.

For users in Thailand who pay with THB , the CFTC's move is a sign that some types of forecast markets may be subject to increased scrutiny. Even crypto platforms registered under Thai regulatory agency the SEC (Thailand) such as Bitkub might not have this product directly, while users in Myanmar who may use cross-border platforms should check for legal status, withdrawals and unblocking services because certain kinds of forecasts may be restricted by local platform or authority policies.

What remains to be seen.

The next question is whether the DMO will turn its September 22 guidance into a code of practice; how the CFTC will use arbitration to review contracts that affect speech, attendance or personal interaction; and if the global platform will adjust product listings in line with their risk for disruption. Users should follow the announcements of the marketplace they are using directly to understand which contracts constitute high-risk products and which may be restricted or removed from the system.

Warning of danger.
