French Hill points out that the rule of SEC is not as stable as the CLARITY law, while there are seven vacancies in governing bodies.
Hill's point of view.
French Hill, an Arkansas representative and chairman of the U.S. Senate Committee on Financial Services, told Fox Business on Wednesday that while US financial regulators are moving forward with their handling of digital assets, the executive branch's actions have not been as long-term stable as legislation passed by Congress.
After drawing up a clear definition of the digital asset market, it didn't pass.
Hill's remarks came after the U.S. Senate failed to pass the digital asset Market Clarity Act, or CLARITY, last month,SEC and the Commodity futures trading Commission is in the midst of a legislative process to deal with many aspects of crypto regulation and enforcement, but Hill noted that measures coming out following the passage of Clarify are not comparable as a legal solution.
Hill also expressed hope that CLARITY would pass by the end of his term in Congress, noting that the U.S. needs permanent legislative changes to make the country number one for digital assets and blockchain technology.
Pressure from the head of a regulatory agency.
Hill's move is consistent with the stance of Paul Atkins, chairman,SEC and Michael Selig, Chairman of the Commodity futures trading Commission announcing plans to move forward regulating cryptocurrencies along a path set by U.S. President Donald Trump.2027
Time and space constraints.
Hill noted that after the U.S. midterm elections in November, by the time a new Congressman takes office in 2017,2027 the Senate will have only 22 days of open session, so election results may weigh on members' decisions as each person knows whether he or she is returning to the chamber or expiring in January.
Additionally, as of Wednesday, the two regulatory agencies had a total of seven executive-level vacancies for [17] after Hester Peirce announced her resignation last week leaving only Atkins and Mark Uyeda; while the Commodity futures trading Commission has Selig serving as its chairman and sole director.

The point to watch is whether CLARITY passes at the end of its term, and how much a regulatory agency vacancy will impact regulation because in the absence of a permanent rule, market observers must evaluate regulatory certainty from an agency's process rather than a Congressional decision.
