The chairman of ESMA revealed that the focus of MiCA has shifted from regulation to supervision.

ESMA has announced a new crypto regulatory guideline for the year 2027 focusing on operational security and external systems.

What's this about?

The European Securities and Markets Authority (ESMA) unveiled its 2027 annual work plan on Monday, noting that it will focus national crypto regulatory coordination in three main areas: operational resilience, outsourcing risk, and the need for companies to be sufficiently active within the EU.

Such a plan exists while enforcement of the Markets in Assets Regulation (MiCA) continues to intensify.

Why is this important?

Verena Ross, the chair of ESMA said at a meeting of the European Parliament's Economic and Financial Affairs Committee on Monday that the agency's focus under MiCA has shifted from regulation to supervision and convergence.

"We want innovation to flourish within a framework that creates clarity for companies, guarantees for investors and builds trust in the marketplace", Ross said.

The move reflects that regulators across the European Union are entering a real enforcement phase after years of drafting regulations, which means crypto-asset service providers (CASPs) will face increased scrutiny in practice rather than just following rules on paper.

What's ESMA going to focus on?

The 2027 Plan states that national regulatory authorities must coordinate more closely in the regulation of CASPs, with a focus on:

  • Stability of operations.
  • The risks of outsourcing.
  • Condition of the hull.
  • It's called reverse solicitation.
  • Identifying the type of asset.

ESMA also aims to standardise the phased reporting of CASPs to national regulators, promote common risk metrics and develop supervisory dashboards in a consistent manner.

What is the MIDAS surveillance system?

ESMA plans to roll out MIDAS, which is a centralized crypto market surveillance system for tracking abusive trades under MiCA.

The agency expects the first phase of the system to be fully operational by 2027. Earlier, ESMA unveiled plans for a second phase in February.

How would that affect the MiCA review?

ESMA also plans to incorporate regulatory experience into the European Commission's MiCA review, which is expected to be completed by June 2020 and prepare for any legislative proposals that may follow.

What does this mean for our readers?

For crypto providers operating in the European Union or planning to expand, this roadmap signals that a period of laxity is coming to an end: having strong operational systems, transparent external recruitment structures and adequate teams working within the EU will become more than just a document.

For investors, stricter regulatory oversight on operational security and availability may reduce the risk of a platform ceasing to operate mid-shift or experiencing an issue with availabilities but could also cause some providers to pull out of EU markets due to higher compliance costs.

For the markets in Thailand and Burma, this development signals a direction that regional regulators may consider issuing regulations for digital asset providers in the country. However, investment decisions still depend on individual-specific factors and risk tolerance.

It's a warning.
