When Krypto stopped waiting for Congress, and turned to making friends with the regulatory agencies...

What is the Clarity Act and when did it break?

The Clarity Act is a U.S. cryptocurrency framework bill that's been in the works for over a year, with Senator Cynthia Lummis as its chief architect; it aims to set clear boundaries where crypto will be governed by one piece of legislation rather than being interpreted differently.

But when the Senate voted 49 to 50 last week in a procedural vote, falling short of the 60 needed for Democrats to oppose with three Republicans also opposed, one point that remained unchallenged was President Donald Trump's crackdown on crypto-related ethics.

How important? Because it changes the player in a supervisory game.

What's cool is that within 48 hours of the crash, a regulatory agency came out and ran the game itself:

  • He is a member of the Democratic Party.SEC In the biggest spotlight, Chairman Paul Atkins issued an "innovation exemption" for digital assets, citing a failure of the Clarity Act to allow qualified traders to trade U.S. tokenized securities on blockchains without registering with national securities exchanges.
  • The CFTC. Going two ways at once: Staff issued a no-action position to passive software providers, including the cryptocurrency wallet app, allowing users to access derivatives under control without registering as introducing brokers and also sending draft crypto market regulations to the White House for review (not disclosed).
  • The Federal Reserve The rule mandates that stablecoin issuers under the Federal Reserve's supervision must back up full collateral with safe, high-quality assets and hedge funds to cover operational risk. It was part of Trump's GENIUS Act enforcement legislation signed in 2012,2025 which the OCC is also rushing to finalize its own stablecoin rules by November before their statutory expiration date in January.

Have you met anyone in Thailand or Myanmar?

Signals from this global regulatory superpower are being picked up by agencies across the region, including GLOT.SEC Thailand has already developed its own digital asset regulation framework ifSEC America allows tokenized stocks to be traded on chains. Such a trend is often cited as a lesson in comparison with Thai markets that buy and sell cryptocurrencies via THB platforms approved by the FOMC.2025 The Fed's stablecoin rule also directly affects the use of stablecoin people in Yemen who rely on these assets as cross-border payment channels.[3]

Pros and cons of using "order" instead of "law".

Kristin Smith, president of the Solana Policy Institute says that the industry "is now looking to regulators for guidance", and calls it a "more realistic path forward".

But there's a technical caveat to understand: agency rules. It's written slower, it can be prosecuted more easily and reversed by subsequent governments. The actual law.

Anyone who remembers when Gary Gensler was presidentSEC would understand that during the administration of Joe Biden,SEC a "regulation by enforcement" policy was implemented, which prevented crypto executives and market structure regulators from returning to such days.

So now the industry has to choose what's available, which is regulation from agencies that used to be hostile rather than legislation from a set of pro-crypto advocates that are as friendly as they have ever been.

Whether these regulations will hold up is a story that we'll be watching for months and maybe years to come.

It's a warning.
